Chapter 4 of the Hernando County Code of Ordinances regulates the location of, and requires a permit for Bottle Clubs. The permitting of Bottle Clubs is pre-empted to the State; however, the location of Bottle Clubs can be regulated by the local jurisdiction consistent with the adopted zoning regulations for establishments that sell alcohol. The proposed ordinance repeals the requirements contained in Chapter 4, and includes Bottle Clubs in Appendix A (Zoning) relative to the zoning requirements for establishments that dispense alcohol (bars, taverns, etc.).


A draft of the proposed ordinance with the amendment in strike-through/underline format is attached for consideration by the Planning and Zoning Commission.

Mr. Pianta gave an overview of the proposed amendment to the Code of Ordinance, Chapter 4, Section 4-3; and Appendix A, Article I, Section 3 and Article III, Section 3. The amendment proposes to repeal the requirements relative to bottle clubs contained in Chapter 4 and include zoning requirements for establishments that dispense alcohol in Appendix A.

It is recommended that the Planning and Zoning Commission review the proposed ordinance amendment and make a recommendation to the Local Planning Agency / Board of County Commissioners for public hearings scheduled on December 12, 2017, at 9:00 AM; and January 9, 2018, at 9:00 AM.

Mr. Pianta and Mr. DiNovo described bottle club venues for the Commission.

There was no public comment.

Motion: A motion was made to recommend approval to the Local Planning Agency/Board of County Commissioners per staff recommendations.
